Comprehensive benefits solutions for Illinois employers managing statewide and Chicago-specific regulatory requirements.
Illinois (IL)
Illinois has steadily expanded employee benefits requirements, with statewide paid leave legislation, the Illinois Secure Choice retirement savings mandate, and Chicago's separate paid leave ordinance creating a layered compliance environment. The state's economy, centered on Chicago's diverse industries but extending through significant manufacturing, agriculture, and logistics sectors statewide, demands competitive benefits. Illinois employers must navigate both state and local mandates while competing for talent in the Midwest's largest metropolitan area.
Illinois enacted the Paid Leave for All Workers Act, effective January 2024, requiring all employers to provide at least 40 hours of paid leave per year that can be used for any reason. Leave accrues at one hour per 40 hours worked. This is one of the broadest paid leave laws in the nation because it does not restrict the reasons for use. Chicago has its own separate and more expansive ordinance (Chicago Paid Leave and Paid Sick and Safe Leave Ordinance) requiring both paid leave and additional paid sick leave.
Illinois Secure Choice requires employers with 25 or more employees that do not offer a qualified retirement plan to enroll employees in the state-facilitated Roth IRA program. The program has phased in over several years, with penalties for non-compliant employers. Illinois does not mandate state disability insurance or state-run paid family leave insurance, though legislative proposals have been considered. Federal FMLA applies, and Chicago and Cook County have additional leave ordinances.
Illinois defines the small group market as 2 to 50 employees. The state requires guaranteed issue and community-rated pricing for small group plans.
Illinois has a robust healthcare market, particularly in the Chicago metro area, with carriers including Blue Cross Blue Shield of Illinois, UnitedHealthcare, Aetna, Cigna, Humana, and several HMO options. Chicago offers some of the most extensive provider networks in the Midwest, anchored by Northwestern Medicine, Rush University Medical Center, Advocate Aurora Health, and the University of Chicago Medicine. Downstate Illinois has more limited options, with regional health systems serving central and southern communities.
Chicago's diverse economy spans financial services, technology, professional services, manufacturing, transportation and logistics, healthcare, and education. The city competes for talent with other major tech hubs and financial centers. Downstate Illinois has a strong manufacturing, agriculture, and healthcare employment base. The wide economic diversity means benefits strategies must be tailored to specific workforce demographics, from high-end executive benefits in Chicago's Loop to competitive hourly packages in manufacturing and distribution centers.
Illinois operates Get Covered Illinois through the federal marketplace at HealthCare.gov. ACA compliance is required, and Illinois adds state-level mandated benefits in insured plans including mammography, diabetes coverage, mental health parity, substance abuse treatment, and coverage for autism. The state has also enacted contraceptive coverage requirements that go beyond federal mandates.
Employers operating in Chicago face additional compliance layers from the city's separate paid leave and sick leave ordinance, the Chicago Fair Workweek Ordinance (for certain industries), and Cook County ordinances. Illinois Secure Choice compliance requires ongoing enrollment of eligible employees and remittance of contributions. Employers with workers in multiple Illinois jurisdictions should map the overlapping requirements carefully. The state also has specific regulations around plant closings and mass layoffs (the Illinois WARN Act) that require 60 days' notice for benefit continuation purposes.
